Purpose Artificial intelligence (AI) has sparked interest in various areas, including marketing. However, this exhilaration is being tempered by growing concerns about the moral and legal implications of using AI in marketing. Although previous research has revealed various ethical and legal issues, such as algorithmic discrimination and data privacy, there are no definitive answers. This paper aims to fill this gap by investigating AI’s ethical and legal concerns in marketing and suggesting feasible solutions. Design/methodology/approach The paper synthesises information from academic (...) articles, industry reports, case studies and legal documents through a thematic literature review. A qualitative analysis approach categorises and interprets ethical and legal challenges and proposes potential solutions. Findings The findings of this paper raise concerns about ethical and legal challenges related to AI in the marketing area. Ethical concerns related to discrimination, bias, manipulation, job displacement, absence of social interaction, cybersecurity, unintended consequences, environmental impact, privacy and legal issues such as consumer security, responsibility, liability, brand protection, competition law, agreements, data protection, consumer protection and intellectual property rights are discussed in the paper, and their potential solutions are discussed. Research limitations/implications Notwithstanding the interesting insights gathered from this investigation of the ethical and legal consequences of AI in marketing, it is important to recognise the limits of this research. Initially, the focus of this study is confined to a review of the most important ethical and legal issues pertaining to AI in marketing. Additional possible repercussions, such as those associated with intellectual property, contracts and licencing, should be investigated more deeply in future studies. Despite the fact that this study gives various answers and best practices for tackling the stated ethical and legal concerns, the viability and efficacy of these solutions may differ depending on the context and industry. Thus, more research and case studies are required to evaluate the applicability and efficacy of these solutions in other circumstances. This research is mostly based on a literature review and may not represent the experiences or opinions of all stakeholders engaged in AI-powered marketing. Further study might involve interviews or surveys with marketing professionals, customers and other key stakeholders to offer a full knowledge of the practical difficulties and solutions. Because of the rapid speed of technical progress, AI’s ethical and regulatory ramifications in marketing are continually increasing. Consequently, this work should be a springboard for more research and continuing conversations on this subject. Practical implications This study’s findings have several practical implications for marketing professionals. Emphasising openness and explainability: Marketing professionals should prioritise transparency in their use of AI, ensuring that customers are fully informed about data collection and utilisation for targeted advertising. By promoting openness and explainability, marketers can foster customer trust and avoid the negative consequences of a lack of transparency. Establishing ethical guidelines: Marketing professionals need to develop ethical rules for the creation and implementation of AI-powered marketing strategies. Adhering to ethical principles ensures compliance with legal norms and aligns with the organisation’s values and ideals. Investing in bias detection tools and privacy-enhancing technology: To mitigate risks associated with AI in marketing, marketers should allocate resources to develop and implement bias detection tools and privacy-enhancing technology. These tools can identify and address biases in AI algorithms, safeguard consumer privacy and extract valuable insights from consumer data. Social implications This study’s social implications emphasise the need for a comprehensive approach to address the ethical and legal challenges of AI in marketing. This includes adopting a responsible innovation framework, promoting ethical leadership, using ethical decision-making frameworks and conducting multidisciplinary research. By incorporating these approaches, marketers can navigate the complexities of AI in marketing responsibly, foster an ethical organisational culture, make informed ethical decisions and develop effective solutions. Such practices promote public trust, ensure equitable distribution of benefits and risk, and mitigate potential negative social consequences associated with AI in marketing. Originality/value To the best of the authors’ knowledge, this paper is among the first to explore potential solutions comprehensively. This paper provides a nuanced understanding of the challenges by using a multidisciplinary framework and synthesising various sources. It contributes valuable insights for academia and industry. It is shown how to identify potential signatures of noncommutative geometry within the decay spectrum of a muon in orbit near the event horizon of a microscopic Schwarzschild black hole. This possibility follows from a re-interpretation of Moffat’s nonsymmetric theory of gravity, first published in Phys. Rev. D 19:3554, 1979, where the antisymmetric part of the metric tensor manifests the hypothesized noncommutative geometric structure throughout the manifold. It is further shown that for a given sign convention, the predicted signatures counteract (...) the effects of curvature-induced muon stabilization predicted by Singh and Mobed in Phys. Rev. D 79:024026, 2009. While it is unclear whether evidence for noncommutative geometry may become observable anytime soon, this approach at least provides a useful direction for future quantum gravity research based on the ideas presented here. Classic analytic approaches, such as that advanced by Peter Singer (1975) and Tom Regan (1983), while having a powerful shaping effect on the language of animal advocacy, have been slow to dent academic endeavor, and (...) have failed to significantly impact the research questions posed by some disciplines. This paper explores the commodification of animals, beginning with Marx’s description of how value arises within a system of exchange. Drawing from Irigaray, I observe that value in animals is both arrived at through the use value of the animal as a commodity for human consumption and as a form of currency which serves a function in reproducing the value of the “human” itself. Extending this further, I reflect on Derrida’s discussion of the metaphor as a way to understand the (...) removal of the skin of the animal in order to produce value. As I argue, we find here a convergence of material and symbolic violence which produces value in a way which is distinct from other commodities, and participates in generating the “mirage” of human sovereignty over other animals. In this age of “free-sex”, gurus, Hare-Krishna chanters and transcendental meditation teachers J. Кrisimamurti stands almost alone as a non-guru of outstanding grandeur. His lecture tours in major centers of the world remind one of the historical Buddha who reversed the Upanishadic tradition of teaching in a forest hermitage to a select few by travelling on foot from village to village in North-Eastern India to carry his message of love, compassion and understanding to the masses regardless of caste, color or (...) sex. But historical comparisons are never complete. Whereas the Buddha used the local dialect, adapted his message to the intellectual level of his audience and made free use of stories and parables, Krishna-multi lectures in the English language in his intense analytic style to rapt audiences without any such aid. No wonder the Buddha's appeal and impact historically has been infinitely wider than that of Krishnamurti. And yet, both eschewed dogma, tradition and metaphysical subtleties, and deliberately refused to offer any sugar-coated pills and panaceas for overcoming the pervasive human condition of suffering. They endeavoured to make people “see” and “understand” the human condition in an act of total awareness so as to take them to the very brink of that “creative emptiness”, ultimate freedom and radical change which alone is conducive to the attainment of transcendent peace. In other words, the doctrine of Krishnamurti as that of the Buddha is not for the weak and effeminate who need “crutches” of all kinds but for those who have the courage to help themselves by an act of understanding the way things are without being entangled in theories and conceptual puzzles. It is the intention of this paper to analyze, understand and critically evaluate Krishamurti's concepts of self, action and freedom. (shrink)

The fundamental principle holds a strong ground in Ayurveda. Every medical stream has its own science in which its matter is developed, evolved and explained. From creation of living to issues of health, disease and its treatment these fundamental principles are the root. These can be enumerated as Tridosha, Panchamahabhuta, Prakriti, Ojas, Dhatu, Mala, Agni, Manas, Atma etc. They are most unique and original approach to the material creation and it has all scope to incorporate the modern development in the (...) elemental physics. The aim of Ayurveda is to maintain the proper equilibrium of dosa, dhatus, and mala constituent in order to preserve health in a healthy person and cure a disease in a diseased person.The presence of cognition as well as the absence of cognition is an indication of the mind. In the presence of senses with senses object and soul the man does not perceive a thing in the absence of mind that is to say that senses are unable to grasp the object in the absence of Manas. The term Ojas has been used in Ayurveda for the factor which prevents decay and degeneratioif the body and provides strength and support against a disease. Concept of Agni which incorporates all activities and factors responsible for digestion and metabolism in the living organism as known today, knowledge to these fundamental principles is a key to health and diseases .Maintenances of health depend on good and sound knowledge of these. I present a Third World critique of the trend in American environmentalism known as deep ecology, analyzing each of deep ecology’s central tenets: the distinction between anthropocentrism and biocentrism, the focus on wildemess preservation, the invocation of Eastem traditions, and the belief that it represents the most radical trend within environmentalism. I argue that the anthropocentrism/biocentrism distinction is of little use in understanding the dynamics of environmental degredation, that the implementation of the wildemess agenda is causing serious deprivation in the (...) Third World, that the deep ecologist’s interpretation of Eastem traditions is highly selective, and that in other cultural contexts radical environmentalism manifests itself quite differently, with a far greater emphasis on equity and the integration of ecological concems with livelihood and work. I conclude that despite its claims to universality, deep ecology is firmly rooted in American environmental and cultural history and is inappropriate when applied to the Third World. (shrink)

Since the onset of the COVID-19 pandemic, a controversial criterion for allocating scarce medical treatment has been defended and incorporated into policy: the criterion of equity. Equity-included allocation schemes prioritize, to some degree, patients from marginalized or historically disadvantaged racial/ethnic groups, or patients with low socioeconomic status, for scarce treatment. The use of such criteria has been most prominently defended in two ways: (1) as reflecting a risk factor for severe COVID-19, and thus as a way of tracking medical need, (...) and (2) as a form of remedial justice, viz. a way of redressing disparities in COVID outcomes that are caused by underlying unjust social conditions. Here, we delineate and critique those arguments. We argue that not only are such arguments unconvincing but also that there are compelling moral reasons to reject the sort of equity-included allocation schemes at issue. (shrink)

This essay reads John Locke’s Two Treatises through its nonhuman animal presences, especially the emblematic figures of cattle and “noxious creatures” like “lyons,” “tygers,” and wolves. It argues that the real ground of Lockean human equality is an ongoing practice of subjugating nonhuman animals, and not any attribute of the human species as such. More specifically, the Lockean social compact founded on this equality relies on a “dominion covenant,” an existential “agreement” in which God lends the power of dominion to (...) man and any threats to this order require punishment. This dynamic enables violence toward humans, in the name of their humanity, if they do not properly exert their power of dominion. Critics have connected Locke’s theory of property to indigenous dispossession and his theory of punishment to carceral systems; both processes, I argue, intimately rely on the dominion covenant. Lockean racism is the fulfillment of, and not a deviation from, his account of human equality. (shrink)

In an attempt to explore further the Madelung fluid-like representation of quantum mechanics, we derive the small perturbation equations of the fluid with respect to its basic states. The latter are obtained from the Madelung transform of the Schrödinger equation eigenstates. The fundamental eigenstates of de Broglie monochromatic matter waves are then shown to be mapped into the simple basic states of a fluid with constant density and velocity, where the latter is the de Broglie group velocity. The normal modes (...) with respect to these basic states are derived and found to also satisfy the de Broglie dispersion relation. Despite being dispersive waves, their propagation mechanism is equivalent to that of sound waves in a classical ideal adiabatic gas. We discuss the physical interpretation of these results. (shrink)

Arthāpatti does not depend on observation of pervasion or background belief. It is certain in the sense that when S cognizes P through postulation, no other epistemic instrument would invalidate P. The Naiyāyika tries to reduce postulation to anumāna and/or tarka. I shall argue that it is neither. Due to its explanatory role, one may think that postulation plays an essential role in lakṣaṇā or indication. But this too is a misconception. Both tarka and lakṣaṇā depend on observation and background (...) knowledge. Neither of them has the epistemic certainty postulation enjoys. I think, due to its observation-independent nature and certainty, postulation can be seen as the source of the knowledge of the truths of reason. (shrink)

Once regarded as cellular ‘debris’ extracellular vesicles (EVs) emerge as one of the most intriguing entities in cancer pathogenesis. Intercellular trafficking of EVs challenges the notion of cancer cell autonomy, and highlights the multicellular nature of such fundamental processes as stem cell niche formation, tumour stroma generation, angiogenesis, inflammation or immunity. Recent studies reveal that intercellular exchange mediated by EVs runs deeper than expected, and includes molecules causative for cancer progression, such as oncogenes (epidermal growth factor receptor, Ras), and tumour (...) suppressors (PTEN). The uptake of oncogenic EVs (oncosomes) by various cells may profoundly change their biology, signalling patterns and gene expression, and in some cases cause their overt tumorigenic conversion. Moreover, EVs circulating in blood and present in body fluids provide an unprecedented access to the molecular circuitry driving cancer cells, and new technologies are being developed to exploit this property as a source of unique cancer biomarkers. The meaning of the term ‘tarka’ is not clear in the modern literature on Classical Indian Philosophy. This paper will review different modern readings of this term and try to show that what the Nyāyasūtra and its classical commentaries called a ‘tarka’ should be understood as the following: a tarka is a cognitive act that validates a content (of a doubt or a cognition or a speech-act) by demonstrating its logical fitness or invalidates a content by demonstrating its logical unfitness. (...) A tarka can act as a metatheory too. Generating certainty is, according to the Classical Nyāya, a job assigned to an epistemic instrument ( pramāṇa ). It fails to do so when there arises a doubt regarding it. The moment a tarka dispels the doubt, the epistemic instrument generates certainty. Tarkas of different types will be exemplified by critically analyzing Gaṅgeśa’s applications of tarka in his magnum opus Tattvacintāmaṇi . These examples will clarify the definition of tarka formulated in this paper. (shrink)

When somebody speaks metaphorically, the primary meanings of their words cannot get semantically connected. Still metaphorical uses succeed in conveying the message of the speaker, since lakṣaṇā, a meaning-generating faculty of language, yields the suitable secondary meanings. Gaṅgeśa claims that lakṣaṇā is a faculty of words themselves. One may argue: “Words have no such faculty. In these cases, the hearer uses observation-based inference. They have observed that sometimes competent speakers use the word w in order to mean s, when p, (...) the primary meaning of w does not make any semantic sense. In all such cases, s is actually related to p. After having observed this, when the hearer hears the utterance of w, and realizes that w’s primary meaning p is semantically unfit for the sentence-meaning, they infer on the basis of their prior observation that ‘the competent speaker must mean s by uttering w’. Thus lakṣaṇā becomes a success.” This apparently well-argued reduction does not stand the critical examination; neither in Gaṅgeśa’s framework, nor even in the general theory of language. For one can compose and interpret potentially infinite novel sentences based on lakṣaṇā while the observational inferences one can make are finite. Gaṅgeśa says very clearly that as far as the secondary meaning is concerned, no prior observation is required. This paper will argue that not only does language yield secondary meanings through lakṣaṇā, but it also restricts the use of secondary meanings; for one cannot mean just anything by saying something. Lakṣaṇā is a creative function with infinite potential within the limits set up by the language faculty. (shrink)

Mary Midgley challenges the dominant conceptions of human nature, ethics, community and ecology taught at A-Level. This article considers some of the key themes of her thinking.

The objective of the paper is to explicate and critically appreciate two forms of consequentialism, namely objective and subjective consequentialism. Consequentialism is a substantive moral theory according to which moral value or good is to produce/promote best consequences (in a sense welfare); and morally right consists in acting so as to promote maximum good (in case of utilitarianism) or to promote best or most good. However, the paper considers important questions, replies to which give us two forms of consequentialism, namely (...) subjective and objective consequentialism, each having their unique features, nuances and limits. Moot problems are as follows: Whether consequentialism as a theory of good is to promote actual good, that is good as matter-of-fact or expected good, that is good expected by the moral agent; and whether as a theory of right, it urges to make decisions for the promotion of good based on some heuristic devices or subjective motives, commitments and so on. Objective consequentialism, as a theory of good prefers promotion of actual good than expected good, and as a theory of right decision-making urges the moral agents to rely on heuristic devices than subjective factors. The contest has been absorbing and fierce, each having so-called strong arguments. The paper reconsiders these contesting arguments and critically examines those to conclude in favour of objective consequentialism on important counts notwithstanding, the value of motives, motivations and commitments of moral agents. Adriana Cavarero offers an answer that roots human speech in embodied vulnerability, in contrast to philosophical emphases on disembodied rationality. In the face of what she calls horrorism, which puts humans in proximity to animality, she calls for resuscitating vocality, and therefore humanity, from loss. This article reads Kafka’s short story “A Report to an Academy” – which structurally (...) resembles a slave narrative and concerns a kidnapped ape who learns to speak – to extend Cavarero’s emphasis on vulnerability while challenging her humanism. In Kafka, modern horror’s locus is not animality but the abstract human, and it projects the unstable distinction between voice and noise onto blackened humans and nonhuman animals. (shrink)

This article investigates the question concerning moral deskilling in the context of autonomous weapon systems. To this end, it interrogates the appropriateness of deskilling as an analytical tool, the consequences of the conflation of the terms “the warrior” and “the soldier,” and the impact of the dominant, but commonplace, understanding of autonomous weapons that underwrites the concerns that have been expressed thus far. While affirming the critical importance of the question regarding moral deskilling in the context of advanced weapons and (...) technologies, this article argues (a) that the notion of deskilling may not be an adequate or even appropriate analytical tool to investigate the matter on hand; (b) that the conflation of the terms “the warrior” and “the soldier” only serves to obfuscate the critical issues at stake; and (c) that the understanding of autonomous weapons that underwrites the concern is highly speculative. To this extent, the concern regarding moral deskilling in the context of autonomous weapon systems is ill-served. By way of a conclusion, the article calls for a more careful and nuanced approach and makes some preliminary suggestions as to how the question regarding moral deskilling in the context of autonomous weapon systems may be addressed. Under mounting pressure from the international communities and organizations to curb carbon emission causing disturbing climate change, and the growing pressure of domestic environmentalists and the common man in India, the government is hard-pressed to enact laws on carbon emission. However, the moot problem is whether to consider a pro-active rule of action seriously to curb carbon emission while keeping the collective scenario in view or to consider a case-by-case scenario in view. A number of people argue that a collective (...) approach is much better, and for that matter, pro-active general rules of actions are desirable for their outcomes or consequences are good or worthwhile. This is what we now call rule consequentialism, which is much different from the case-by-case act consequentialism. In this case, the rightness of political action is determined by following some rules (or policies) which are amenable to worthwhile consequences. Similarly, we may conceive of a number of general rules of action such as “curb corruption”, “curb apartheid”, “curb exploitation of woman” and so on. In this paper, I would like to revisit rule consequentialism as a normative theory of rightness of action that is not immoderately overdemanding on moral agents. However, I would justify why rule consequentialism is not only overdemanding of moral agents but immoderate as well. Hence, it is an untenable normative theory of rightness of action. (shrink)
